The signing of the Booking Form is your acceptance that you (from here to be referred to as Guest) have read and understand all of the terms and conditions outlined below. Once the Guests has returned the Booking Form with your $400 non-refundable deposit, the party on that form will be responsible for the rental payment in total. The full amount must be paid 10 weeks prior to your departure along with a $500 Security Deposit. If the full balance is not received at this time we reserve the right to cancel the Guest’s booking. In these circumstances the Guest’s deposit will be forfeited.
Price includes reasonable use of utilities but NOT pool heating, flights, car rental, vacation insurance etc. Prices are subject to currency fluctuations and government action.
While we (from here to be referred to as the Owner) reserve the right to increase or decrease accommodation prices at any time, confirmations will reflect current rates at the time of booking. Once booking is confirmed and deposit is submitted, the cost of the rental is guaranteed against any further increase. This guarantee is offered subject to our terms and conditions and payment structure being followed and providing you do not make further amendments to your vacation arrangements. The person, who signs the Booking Form certifies that he or she is authorized to agree to the Booking Terms and Conditions on behalf of all persons included on the Booking Form, including those substituted or added at a later date. The signatory must be a member of the party occupying the property and must be 21 years or over. Bookings cannot be accepted from individuals less than 21 years of age. Any unauthorized occupancy by people not listed on the booking form will be subject to loss of security deposit and immediate termination of the rental agreement
Security Deposit A $500 refundable security deposit is required to guard against possible damage, loss or excessive cleaning of the property incurred during your rental period. This will be refunded within 28 days of the end of your stay subject to the following conditions: - All keys are returned - Any damage or loss noted by Guest is reported immediately to the Owner’s Management Company upon arrival. Failure to do so will make any subsequent changes invalid. - Property is left in good condition and so reported by the Owner’s Management Company after the Guest’s rental period. - Guests make good minor breakages - To permit the Owner's agent reasonable access to the property to carry out any maintenance that may be necessary - Any stains to the Carpets, Bedding or Furniture must be cleaned.
Failure to comply could result in deduction of Security deposit. We reserve the right to pursue the Guest for any damage or loss in excess of this sum.
We reserve the right to treat the booking as cancelled if we do not receive the balance and security deposit by the due date. Any cancellation charges detailed elsewhere in this document will then apply.
In the event of a returned check, a charge of $25 to cover the bank charges and our administration costs.
Arrivals and Departures The property will be available to you from 4.00pm on the day of your arrival. It must be vacated by 11.00am on the day of your departure, unless otherwise agreed with the Owner’s Management Company.
Cancellations In the unlikely event that circumstances beyond the Owners control necessitate the cancellation of the rental agreement, the Owner reserves the right to cancel any bookings at any time and will only be liable to refund monies already paid by the Guest. If Guest needs to cancel booking, the Owner should be contacted immediately by telephone followed by confirmatory letter. Cancellations prior to 60 days before departure would involve the loss of your booking deposit. 30 – 60 days you would 50% of rental fee forfeited, 30 days or less, the total amount of the rental fee is forfeited. Cancellations for reasons beyond your control should be covered by your travel insurance. Any recovery of your losses should be taken up with your travel insurance company.
Extra Equipment All extra items, VCR, DVD, Stereo System, X Box game system, etc are left by the Owners for your use in good faith. No responsibility can be taken by the Owners if they are missing or not functioning.
Pool The pool is cleaned and chemically balanced every week for your safety and comfort, however on rare occasions it may be necessary to apply extra chemicals to the pool to maintain safe and accurate chemical levels, should this occur during your stay it will be necessary for you to be out of the pool for a period of 12-24 hours for safety reasons.
The Owner is not responsible for the weather. If pool heating is ordered, it must be paid for, regardless of the outside temperature. The solar blanket must be used when pool is not in use (especially at night) or the heater will not function correctly. The heater is a mechanical device, as with any mechanical device it can be subject to electrical/mechanical failure. If such an occurrence were to happen, every effort will be made to repair the heater. If the Guest has paid for pool heat, then the Owner shall refund the days the Guests are without pool heat. We cannot and will not refund for anything that has not been paid for. The pool Safety fence must be kept erected at all times for the safety of children and all posted safety rules must be followed to ensure the safety of all. Guests use of the pool is at the Guests own risk. Do not allow unsupervised children to use the pool, spa. Items such as clothes, toys etc. must not be left in the spa. Failure to use the spa or pool covers may result in additional charges. All doors and windows must be closed to optimize proper functioning of Air Conditioning. Guests are responsible for closing all doors and windows.
Liability The Owners do not accept any liability or responsibility for lost property, injuries, accidents or theft arising from your occupancy in the property. The Guest is responsible for taking out adequate insurance to cover all risks. This waiver also applies to any person visiting the property as guests of the Guests. The Owners do not accept any liability for injury, damage or loss caused, or for any claim made by a third party as a result of actions by the Guest(s) and other persons occupying the property during the period of the let. Children should be supervised at all times.
No liability is accepted by the Owner for loss of main services or failure of appliances, nor for the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the Owner. Furthermore, it is possible that some construction work may take place in the area of new homes. The Guest should establish the status of the development prior to booking
The Owners, servants or agents, of the property will not be liable for any loss or delay occasioned by any “force majeure” including but not limited to the following: strikes, riots, political unrest, war or the threat of war, terrorist activities, industrial disputes, fire, flood, technical/weather problems to transport, aircraft, closure of airports, or any other event beyond the Owner’s control.
Complaints In the unlikely event that you should have a problem with our rental home or its facilities, please bring this to the attention of the Management Company immediately so they can investigate and attempt to resolve the issue as soon as possible. Please note that, as Florida is a tropical State, encountering insects such as ants, mosquitos, flies etc., is inevitable, not cause for complaint. The property is treated periodically as part of a pest and termite control program, and is professionally cleaned.
No Smoking or Pets There is absolutely no-smoking or pets allowed. Please note that contravention of the above will render your booking void and all moneys will be forfeited. If any extra cleaning is needed on fabrics, carpets and furniture etc. to remove tobacco smoke if it is detected by the Management Company, the cost of cleaning these items will be paid by Guest.
Insurance Please ensure that you have obtained adequate vacation insurance to cover any medical expense or vacation cancellations. |
